Data protection FAQ for applicants

We are pleased about your interest in our company and about the fact that you are applying or have applied for a position in our company.

In order to fulfil our information obligations in accordance with Art. 12 et seq. of the Basic Data Protection Regulation (DSGVO), we would like to provide you with the following information on the processing of your personal data in connection with your application by our company.

1. who is responsible for data processing?

2 Which of your data are processed by us? And for what purpose?

We process the data that you have sent us in connection with your application in order to check your suitability for the position (or other open positions in our companies, if applicable) and to carry out the application procedure.

3. on what legal basis is this based?

The legal basis for the processing of your personal data in this application procedure is primarily § 26 BDSG in the version valid from 25.05.2018. This allows the processing of data necessary for the decision to establish an employment relationship.

Should the data be required for legal prosecution after the application procedure has been completed, data processing can be carried out on the basis of the requirements of Art. 6 DSGVO, in particular to safeguard legitimate interests in accordance with Art. 6 Par. 1 lit. (f) DSGVO. Our interest then consists in the assertion or defence of claims.

4. how long is the data stored?

Data of applicants will be deleted after 3 months in case of a cancellation.

In the event that you have agreed to further storage of your personal data to fill future vacancies, we will transfer your data to our “applicant pool”. There the data will be deleted after 12 months at the latest.

If you have been awarded a position as part of the application procedure, the data will be transferred from the applicant data system to our personnel administration and personnel information system.

5. to which recipients will the data be forwarded?

We may use a specialized software provider for the application process. The latter will act as a service provider for us and may also obtain knowledge of your personal data in connection with the maintenance and servicing of the systems. We have concluded an order processing contract with this provider, which ensures that data processing is carried out in a permissible manner.

Your applicant data will be reviewed by the personnel department after receipt of your application. Suitable applications are then forwarded internally to the person responsible for personnel or department for the respective open position. Then the further procedure is coordinated. Within the company, only those persons who need access to your data for the proper course of our application procedure have access to your data.

6. where are the data processed?

The data is processed exclusively at our locations and, if necessary, in computer centres within the Federal Republic of Germany.

7. your rights as “data subject(s)

In accordance with Art. 15 DSGVO, you have the right of access to personal data concerning you. You can contact us at any time for information, for further details and to obtain a copy of the data.

In the case of a request for information that is not made in writing, we ask for your understanding that we may require proof of identity to ensure your legitimacy.

In addition, you have the right to correct and complete your personal data in accordance with Art. 16 DSGVO or to delete it in accordance with Art. 17 DSGVO. You also have the right to restrict processing in accordance with Art. 18 DSGVO – to the extent permitted by law.

You also have a right to data transfer according to Art. 20 DSGVO, i.e. to receive the data provided to us and to request that it be transferred to another responsible party.

Finally, you have the right to object to the processing within the framework of the legal requirements.

Reference to further rights

If personal data is processed by you on the basis of a consent pursuant to Art. 6 I 1 a) DSGVO, you have the right to revoke your consent pursuant to Art. 7 III DSGVO at any time with effect for the future towards us.

Furthermore, according to Art. 21, para. 1 DSGVO grants you the right to object to the processing of your personal data on the basis of a balancing of interests as defined in Section 1 DSGVO. Article 6(2) 1 f) to object to the DSGVO for reasons arising from your personal situation.

To exercise your right of objection, it is sufficient to send an informal notification to the contact details given in point 1, indicating the data processing against which the objection is directed.

9. right of appeal to a supervisory authority

Under Art. 77 DSGVO, you have the right to complain to a data protection supervisory authority about the processing of personal data by us. Among other things, you can contact the supervisory authority responsible for us:
